License for TAPCIS Software
Your first use of the TAPCIS software constitutes your agreement to the
following provisions:
What is TAPCIS? TAPCIS software ("the Software") is a computer program
licensed by Support Group, Inc. ("Support Group") that automates the
process of communicating with the CompuServe Information Service
("CompuServe"), which is offered by CompuServe Incorporated. The
Software is designed to operate on IBM PC and compatible computers under
the MS/PC-DOS operating system.
TAPCIS and CompuServe. Support Group is not affiliated with CompuServe
Incorporated. Since the Software interacts with CompuServe, the ability
of the Software to function is subject to changes in CompuServe.
Try TAPCIS. A limited license at no charge is granted to all CompuServe
subscribers to use, test and duplicate the enclosed version of the
Software for no more than 21 calendar days. After 21 days, you may pay
the license fee or cease using the Software. A two week extension is
available.
License. Upon payment of the license fee, Support Group will grant a
non-exclusive license to use the Software ("Full License"). The number
of licenses you need depends on whether you use the Software for
personal or business use.
Personal Use. If you are using the Software for personal use (which is
any use other than business telecommunications), you will need one Full
License for the lesser of (1) each natural person who uses the Software
in a household, or (2) each computer in a household on which the
Software is used.
Business Use. For business use, you will need one Full License for each
natural person who uses the Software, regardless of the number of
computers used. Where used for both business and personal use, all of
the business licenses are counted first.
License Examples:
(1) You have four people in a household, but only one computer with
the Software is used by all four people to communicate with CompuServe
for personal use. Only one Full License is needed.
(2) You have four people in a household, and all four people use the
Software on three different computers to communicate with CompuServe
for personal use. Three Full Licenses are needed.
(3) You have five people in a household, four of whom use the
Software. One of the four persons uses the Software at work and at
home for both business and personal use. The other three persons use
the Software for personal use at home, where they share a single
computer. In this case, the person who uses the Software for business
use will need one Full License (regardless of whether that person logs

on from home or the business), while the other three persons who use
the Software only at home for personal use will share one Full License
for the single home computer they use.
Transferring Full Licenses to Others. No transfer of a Full License
shall be effective unless (a) the person transferring the license (the
"transferor") notifies Support Group of the name, address and CompuServe
identification of the recipient of the license (the "transferee"), and
(b) the transferor transfers all copies of the Software to the
transferee, and (c) the transferor removes or destroys any other copies
of the Software in the possession or under the control of the
transferor.
Limited Warranty. The Software is distributed and licensed on an "as is"
basis. For a period of ninety (90) days from the date that you pay the
license fees for a copy of the Software, you may return any disks and
documentation provided by Support Group, and destroy all copies of the
Software and the documentation that you have made, and you will receive
a refund of the license fees for the Full License that you paid to
Support Group.
Limitation of Remedies. Should you encounter problems with the Software,
Support Group's entire liability and your exclusive remedy shall be, at
the sole option of Support Group, either (a) to terminate the license
and return any license fees that you paid Support Group for the
Software, or (b) to repair or replace the Software.
Disclaimer of Warranties. Support Group makes no claims as to the
suitability of the Software for any specific use. EXCEPT FOR THE LIMITED
WARRANTY STATED ABOVE, SUPPORT GROUP DISCLAIMS ANY AND ALL OTHER
WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, INCLUDING ANY IMPLIED
WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. The
limited warranty stated above gives you specific legal rights, but you
may have other rights, which vary from state to state.
Limitation of Liability. In no event shall Support Group be liable for
any damages whatsoever arising out of the use of the Software, including
without limitation any direct, incidental or consequential damages, or
any damages for loss of profits, business interruption, loss of
information or any pecuniary loss, even if Support Group has been
advised of the possibility of such damages. Some states do not allow
exclusion or limitation of liability for incidental or consequential
damages, therefore the above limitation may not apply to you.
Pricing. Support Group reserves the right to change at any time and
without notice the license fees it charges for the Software. See the
file ORDER.TAP or the last page of the printed manual for more
information.
